We are committed to protecting and respecting your privacy. Below, we explain the basis on which your personal data that you provide to us or that we collect about you will be processed. We thank you for reading this privacy policy carefully to understand our views and practices regarding your personal data and how we will handle it.

KEY POINTS:

We use your personal data to allow you to benefit from all the features of our Site, to register for the newsletter and the online store, and to provide you with the requested content related to our music and other offers.

Most of our content is not targeted at children. We do not knowingly collect personal data from minors under the age of 15, and we may ask you for your age before subscribing to our newsletters or accessing our content.

If you give us permission, we will send you information and promotional content about MFF Records and our artists. You can change your mind at any time and also ask us not to process your personal data for direct marketing purposes, including profiling.

This policy also specifies the circumstances under which we process your personal data in the interest of our legitimate interests. At any time, you can ask us to stop processing your data.

We make your personal data public when you post content through our sites and applications. We only share your personal data with our business partners and affiliated companies when you have consented to it. We also share your data with artists and, if applicable, their producer, when you have consented and with any third parties we engage to process data on our behalf (such as the host or operator of our site, sending emails or performing data analyses) or when such sharing is required by law, or in certain specific situations.

We may transfer some personal data to the United States and other countries outside the European Economic Area (EEA).

We use cookies and other tracking technologies for content and advertising personalization, as well as to improve the functioning of our Site.

In order to protect your data and ours, we monitor the use of this Site, and we use the information we collect, including personal data, to identify any fraudulent activity or transaction, prevent related abuse, and investigate and/or take legal action for any potential threat or misuse of the Site, ensure compliance with legal notices and privacy policy, and any other measures aimed at protecting the rights and property of MFF Records, its partners, participants, and clients. 2.1.YOUR RIGHTS

Whenever we have obtained your consent to process your personal data, you can withdraw it at any time, provided that we have other legal grounds to process your data for other purposes (as outlined below).

At any time, you have an absolute right to withdraw your consent to profiling and direct marketing.

Under the French Data Protection Act of January 6, 1978, as amended, and the General Data Protection Regulation (GDPR) that came into effect on May 25, 2018, you have the right to access, rectify, and delete personal data concerning you held by MFF Records, which is the sole recipient of this information and uses it solely for the purposes of this Site.

You can request a copy of your personal data and obtain it in a readable, structured, and commonly used format, as well as correct, delete, or restrict its processing.

Additionally, you can object to the processing of your personal data in certain circumstances (notably when we do not need to process your data for contractual or legal purposes, or when we use your data for profiling or direct marketing purposes).

2.2. EXERCISING YOUR RIGHTS

You can exercise these rights by providing your name, surname, and full address, either:

If you do not receive a response from the Data Protection Officer within one month (which may be extended to two months depending on the complexity of your request), you have the right to directly file a complaint with the CNIL.

The exercise of these rights may be limited if fulfilling your request would involve disclosing personal data of another person, which would infringe on their rights, or if you request the deletion of information that the law requires us to retain or that is necessary for our legitimate interests.

In such cases, we will inform you of the exceptions in the GDPR and the French Data Protection Act applicable to your case, in response to your requests.

With your prior consent, your personal data may be shared with business partners for promotional purposes.

If any of your questions remain unanswered, you have the right to inform the French Data Protection Authority (CNIL).

2.3. DATA RELATING TO MINORS

Please be informed that you must be at least 15 years old to register on our Site and to subscribe to our newsletters. We ask that you do not register if you are under 15.

We do not attempt to collect personal data concerning minors under 15; if you believe we have collected such data without your knowledge, please contact us immediately so that this data can be deleted.

NOTE TO PARENTS

Parents should supervise their children's online activities. We encourage them to use parental control tools, which are available online, to help provide a safe environment for their children. These tools can specifically help prevent minors from sharing their name, address, and other personal information online without prior parental consent.

2.4. HOW DO WE COLLECT YOUR PERSONAL DATA?

We collect and process personal data that you provide through forms you fill out on our Site or when you contact us. This includes any information provided during registration on the Site, when subscribing to our offers and services (such as newsletters and online stores), purchasing downloads, sharing content, or requesting additional services.

Mandatory data fields are clearly indicated on the form you complete. If you do not provide this data, you will not be able to complete your registration on the Site or application, participate in a contest, or interact with MFF Records or its artists. Any additional information you provide is optional.

In addition to data collected through any online forms you complete (newsletter, subscription to offers), we inform you that data may also be collected during your navigation on our Site using technological means aimed at enhancing your browsing experience, measuring our audience, and providing targeted advertising. In this context, all such technological means (including cookies, web beacons, log files, etc.) will be referred to as “cookies”. • Our artists (including the physical and/or legal person managing their interests) for whom you have expressed interest and consented to direct marketing, and who will use it in accordance with our policy, to inform you about their news;

• Any third parties in the event of a transfer of MFF Records' business in any form (contribution, sale, merger, liquidation, ...);

• Any third parties for statistical purposes that do not identify individuals (demographic, geographic, age-based data, ...). No personal data (such as name or email address) will be identifiable in these statistics;

• Our artists (including the physical and/or legal person managing their interests) for whom you have expressed interest and consented to direct marketing, and who will use it in accordance with our policy, to inform you about their news;

• Any third parties in the event of a transfer of MFF Records' business in any form (contribution, sale, merger, liquidation, ...);

• Any third parties for statistical purposes that do not identify individuals (demographic, geographic, age-based data, ...). No personal data (such as name or email address) will be identifiable in these statistics;

• In certain special circumstances justified by legal, judicial, or public order imperatives. This may be the case when we believe that disclosing this data is necessary to identify, contact, or take legal action against someone who might cause harm or infringe (intentionally or not) the rights or property of our affiliates and/or artists. Personal data may be shared with government and/or law enforcement authorities if required in the context of the above objectives, or as required by law or necessary for the protection of our legitimate interests, in accordance with applicable laws;

• To our providers in the context of, among other things, contests and sweepstakes you participate in when all or part of the administration of the contest is managed by a third-party provider. This may also mean that your personal data will be included in a list of winners. We also share them with third parties performing tasks on our behalf, such as hosting and operating our Site and applications, sending emails, and performing data analyses.

2.9. DATA RETENTION PERIOD

When we collect data related to your registration or login to our Site, we retain it as long as you remain an active user of our Site.

When your data is collected for direct marketing purposes and/or with your consent, we retain it for a period of two years following our last interaction or until you object to the processing of your data (including during the brief period necessary to address your request). We will keep a record of your request to respect your wishes.

When we process personal data in the context of performing a contract, an e-commerce transaction, or a contest, we retain the data for as long as required by law.

3. INTELLECTUAL PROPERTY

The Site and all of its content (including but not limited to sounds, texts, information, images, trademarks, logos, distinctive signs, software, ...) are governed by French and international copyright and intellectual property laws and are the exclusive property of MFF Records and/or its partners.

Unless prior and express authorization from MFF Records is granted, the representation or reproduction (including but not limited to any translation, adaptation, transformation, arrangement, ...) of all or part of this Site or its components by any means is strictly prohibited and may constitute an act of infringement sanctioned notably by Articles L.335-2 and following and L.716-1 and following of the French Intellectual Property Code.

4. APPLICABLE LAW AND JURISDICTION

These legal notices and privacy policy are governed by French law. In the event of a dispute relating to their validity, interpretation, and/or application, express jurisdiction is given to the competent courts of Paris.

CONDITIONS FOR USING ARTIFICIAL INTELLIGENCE

In addition to the other general terms in effect, the following conditions apply to your access to and use of MFF Records' (MFF) websites and mobile applications.

1. Subject to applicable law, the following acts are strictly prohibited (except where specifically and explicitly authorized by MFF) in connection with any existing and future content, including but not limited to text, images, visuals and covers, videos, data, music, and audio (the 'Content'), whether the Content is hosted on and/or accessible through this website or other websites, online and offline services, landing pages, applications, online stores, or MFF platforms, or, concerning any Content owned or held by MFF, whether it has been communicated to you by MFF, is publicly accessible, or is included in databases such as those of the International Federation of the Phonographic Industry (IFPI) or the National Syndicate of Phonographic Publishing (SNEP):

– Accessing, copying, reproducing, extracting, and/or collecting, in whole or in part, any Content, whether manually or via an automated process such as indexing, crawling, or using any 'robot' ('web scraper,' 'web spider'), 'bot,' to (or to enable a third party to) create, develop, modify, learn, or commercialize any system, tool, or other software using artificial intelligence technologies, including but not limited to machine learning, computer vision or digital vision, natural language processing or generation, generative adversarial networks, and/or diffusion modeling (collectively, 'AI Uses'); and

– Removing, disabling, circumventing, degrading, or otherwise interfering with the features and functionalities of this website designed to limit, restrict, or prevent any particular form of access, use, copying, reproduction, extraction, and/or collection of all or part of the Content in relation to any AI Use.

2. To avoid any ambiguity, Content is expressly excluded ('opt-out') from any right to text and data mining under any applicable international and local laws, including but not limited to the European Union Copyright Directive and the related national implementation, as provided by these laws. MFF reserves all rights on the Content concerning AI Uses. This reservation is in addition to and does not prejudice MFF's rights under Article 7(2) of the European Union Directive (2019/790/EU) and its national implementation within the member states of the European Economic Area.

3. Notwithstanding the above, no provision of these AI Use Conditions is intended to prohibit or restrict automated processing (including indexing and crawling) of Content by search engines solely for the purpose of displaying search results and ranking.

4. In the event of a conflict between these AI Use Conditions and any other terms governing your access to and use of MFF's websites and mobile applications, these AI Use Conditions shall prevail.
